The combination of travel services offered to you is considered a package under the definition of Decree-Law 17/2018 of March 8th. 

Therefore, you will benefit from all EU rights applying to packages. TUGA.ME – Agency, Lda and the organizing agency (Tour Operator) considered for this trip will be fully responsible for the proper execution of the entire package.

Additionally, as required by law, TUGA.ME – Agency, Lda and the service providers have protection to refund your payments and, if transportation is included in the package, to ensure your repatriation in case they become insolvent.

Essential rights under Decree-Law no. 17/2018 of March 8th:

▫️Travelers will receive all essential information about the package before concluding the package contract.

▫️There is always at least one operator responsible for the proper execution of all the travel services included in the contract.

▫️Travelers have an emergency telephone number or contact details to communicate with the organizer or the travel agency.

▫️Travelers may transfer their package to another person, subject to reasonable notice and possibly subject to additional costs.

▫️The price of the package can only be increased if specific costs rise (for example, fuel prices), and if expressly provided for in the contract, and in any case not later than 20 days before the start of the package. If the price increase exceeds 8% of the package price, the traveler may terminate the contract. If the organizer reserves the right to a price increase, the traveler has a right to a price reduction in case of a decrease in the relevant costs.

▫️Travelers can terminate the contract without paying a termination fee and get a full refund of any payments made if any essential element of the package, other than the price, is changed significantly. If, before the start of the package, the responsible organizer cancels it, travelers are entitled to a refund and compensation, if applicable.

▫️Travelers can terminate the contract without paying a termination fee before the start of the package under exceptional circumstances, for instance, if there are serious security problems at the destination likely to affect the package.

▫️Moreover, travelers may, at any time before the start of the package, terminate the contract by paying an appropriate termination fee.

▫️If, after the start of the package, significant elements of it cannot be provided as agreed, suitable alternative arrangements must be offered to the traveler at no extra cost. Travelers may terminate the contract without paying a termination fee, in the event of services not being performed in accordance with the contract, this non-compliance affecting the performance of the package significantly and the organizer failing to remedy it.

▫️Travelers also have the right to a price reduction and/or compensation for damages in the event of non-performance or improper performance of the travel services.

▫️The organizer has to provide assistance if the traveler is in difficulty.

▫️If the organizer or the retailer becomes insolvent, payments will be refunded. If the organizer or the retailer becomes insolvent after the start of the package and if the transport is included in the package, the travelers are assured repatriation.

▫️TUGA.ME – Agency, Lda has taken out insolvency protection with the Travel and Tourism Guarantee Fund, and to activate this, one must appeal to Turismo de Portugal I.P, the entity responsible for its activation.
